Statement of the Ministry of Foreign Affairs of the Islamic Republic of Iran on the Resolution of IAEA Adopted by a Group of Members of the Board of Governors.
The Board of Governors of the International Atomic Energy Agency finally put to vote on 24 September 2005 Resolution Gov/2005/70, while its provisions created a Considerable split within the member states, indicating the absence of international consensus and is considered as an epitome of pressure by certain powers with excessive ambitions.

The Islamic Republic of Iran and a group of like-minded countries made many efforts to avoid such a situation.
The risk of elimination of rights and privileges of the Agencys members and increase in their obligations becoming a custom given rise to have deep concern among member States.
From the very first days when the process of building a dossier on Irans nuclear activities was started by the United States, the Islamic Republic of Iran has tolerated extralegal and unconventional treatments, including measures beyond the safeguards and intrusive inspections, merely out of its respect for its membership at IAEA and its commitment to the NPT. The patience and self restraint exercised by the Iranian side in the process of extralegal and non-technical pressures which were imposed on Iran by certain members of the Agency the throughout 2003 summer, is evident to all. The reason for the most extensive and unprecedented cooperation of the Islamic Republic of Iran with the IAEA and some of its Western members was not for our acceptance of unreal allegations, but for our desire to remove misunderstanding and improper excuses. In order to prove its good will and aimed at international confidence building, despite its inalienable rights the Islamic Republic of Iran adopted in October 2003 important voluntary measures for the resolution of nuclear issues. Regrettably, the latest resolution has jeopardized this path and achievements resulting from these voluntary actions. In this path, the Islamic Republic of Iran has proved many thins In the course of the past three years: · It has cooperated fully with Agency. · Has shown greater transparency with respect to ambiguous points. · Has gradually resolved matters sometimes referred to asfailureorbreachof Iran and ultimately the resolution of them have been confirmed in the DG report of September 2005 in away that the Director General admitted that the Islamic Republic of Iran has not diverted from peaceful nuclear activities. With emphasis that the Islamic Republic of Iran considers the strengthening of principled ties among member States of the Agency and the success of international nuclear management a vital necessity, it will continue collective cooperation in this field in accordance with the following observations: 1- The Islamic Republic of Iran regards the Agency and its Statute as the only competent authority in creating nuclear technological balance and views any irresponsible, unilateral and illegal interventions of the Agency as a threat to future international nuclear management. 2- The Islamic Republic of Iran regards the full and non-discriminatory implementation of the IAEA Statute as an sensitive responsibility of all member States, especially the General conference and the Board of Governors. 3- The Islamic Republic views that the nuclear double-standard and apartheid approach disturbs the balance and stability of international security and is a serious threat to the future of mankind. 4- The minimal interpretation of the rights of nuclearhave-notsand maximal interpretation of the authorities of thehavesgravely threatens the very survival and success of the NPT and international peace and development. 5- The Islamic Republic of Iran considers the excessive insistence of the sponsors of this resolution on imposing illegal conditions on Iran as a move in the direction of customing the deprivation of all member states from their rights. Accordingly, the Islamic Republic of Iran: Regards having full nuclear fuel cycle as its inalienable right, in accordance with the NPT. · Welcomes all efforts aimed at achieving success and full understanding on nuclear issues solely in the framework of NPT, IAEA Statute and the Safeguard Agreement. · Along with those members who did not vote in favor of the resolution of 24 September 2005 and in light of the explicit terms of NPT and IAEA Statute, considers ignorance of the rights and sovereignty of States and extralegal demands as unacceptable and impractical. · In case of failure to amend the resolution or insistence on its implementation, the Islamic Republic of Iran will inevitably terminate all previous voluntary and temporary concessions, including implementation of the Additional Protocol without ratification. · declares that the threat of referral of this case to the Security Council has not made any change in its principled positions and will not help the resolution of the problem. · All investigations and reports by the Agency clearly indicate compliance of Iran with the provisions of disarmament treaties, especially NPT, and the peaceful nature of Irans nuclear activities.

Accordingly, while reaffirming on these positions, regards the allegation of non-compliance as purely political and without any legal foundation.

· Believes that the insistence of some countries on unilateral positions and breaking of the spirit of consensus in the decisions of the Board of Governors is a serious threat for the success of international cooperation in this field.

· Regards equal interaction as its strategic approach in the nuclear field and diplomatic and negotiation framework as the foundation for success, and is prepared to accept all constructive and effective proposals.

· Welcomes talks with various countries for the purpose of facilitating activities of the Agency and invites the EU 3 to alter their radical approach in resolving the atomic issue into interaction and negotiation for understanding.
